FIGHT SANCTUARY STATE FILES STATEWIDE BALLOT MEASURE TO REPEAL SANCTUARY STATE POLICIES

Don Rosenberg, father of a young man killed by an illegal immigrant, has formally filed the “Children, Family, and Community Protection Act” ballot initiative with the State of California today.

The initiative would delete sections of the California Government Code related to two bills passed in 2017, the deceptively-named California Values Act (SB 54) and the Immigrant Worker Protection Act (AB 450). It would require law enforcement officers to cooperate with federal immigration officers, impose criminal penalties on law enforcement officers and government officials who don’t, and eliminate driver’s licenses for illegal aliens.

In his filing, Rosenberg observed the people of California have suffered and are suffering as a result of the lack of leadership from our elected officials – most notably Jerry Brown and Kevin De Leon. “We’re fed up with California’s elected officials playing politics with our lives and prioritizing criminals over citizens and legal immigrants.”

Mercury News: Californians Are Pushing Back On Sanctuary Laws

Leaders like Jerry Brown, Xavier Becerra and Kevin de Leon have taken for granted that Californians will meekly submit to their rules. They, and the nation, are finding out that they have overstepped their bounds with the SB 54, the Sanctuary State law.

At the bill’s signing last fall, state Sen. Kevin de León, D-Los Angeles, who sponsored the legislation and is running for the U.S. Senate this year, said, “California’s local law enforcement cannot be commandeered and used by the Trump administration to tear families apart, undermine our safety and wreak havoc on our economy.”

But a recent survey conducted by the Haas Institute for a Fair and Inclusive Society at the University of California at Berkeley found that the state’s conflicting views on the issue endure: Nearly 2 in 3 respondents supported the principles of the sanctuary-state law, agreeing that local school, law enforcement and medical officials should limit contact with federal authorities. But 59 percent of all respondents also advocated an increase in deportations.

Under the law, county corrections officers can fulfill an ICE request for an undocumented inmate’s release date for two reasons: If the inmate has been convicted in the past 15 years of one of 31 serious crimes, or if probable cause has been found to support a pending charge for one of those crimes.

David Marin, director of the ICE field office in Los Angeles, said county corrections officers often err on the side of caution and deny ICE requests if there is uncertainty around the inmate’s legal status. Getting it wrong could mean a civil suit.

ICE agents, whom the law prohibits from having office space in county jails, may send corrections officers requests to speak to specific undocumented inmates. Once a request is received, corrections officers must deliver it to the inmate, who has a right to decline to speak to the ICE agent. Marin said inmates decline interviews “at least 95 percent of the time.”

“I know California politicians say they want to protect everyone with this law,” Marin said. “But what they are really doing is protecting the criminal alien.”

Exactly. What they are really doing is protecting the criminal alien.

Agnes Gibboney Visits Her Son on the 16-Year Anniversary of His Murder

Sixteen years ago today, Ronald da Silva was murdered – gunned down by a previously-deported illegal alien gang member.

Pro-Sanctuary State politicians claim that enforcing the United States’ immigration laws and deporting criminal illegal aliens is cruel because it separates families. Agnes Gibboney, Ronald’s mother, says she would give anything to have that type of separation instead of the permanent separation she has endured for 16 years now. She visited her son’s grave today, and shares a heartbreaking message. Time does not heal all wounds.

Chuck Woolery and Mark Young Endorse Fight Sanctuary State Ballot Initiative

Chuck Woolery and Mark Young, hosts of the highly-rated podcast ​Blunt Force Truth:The Show​, have endorsed our proposed California ballot initiative to delete sections of the California Government Code created by the deceptively-named California Values Act (SB 54) and Immigrant Worker Protection Act (AB 450) that enshrined Sanctuary in state law.

Woolery highlighted the absurdity of these laws. “Why is there a debate on illegal aliens? Anything called illegal is not up for debate. Any law the places illegal immigrants over the citizens of this county must be opposed. No American should ever fear falling victim to outside invaders.

Young pointed out the dilemma these laws pose for law-abiding Californians, noting that “California’s sanctuary state laws are not only unconstitutional, but morally reprehensible. Fight Sanctuary State Announces California Ballot Initiative to Repeal Sanctuary Laws

Fight Sanctuary State co-founder Don Rosenberg announced the group’s proposed ballot initiative on “Fox and Friends” Wednesday morning.

Many Californians are justifiably outraged by Sanctuary State laws and have focused on repealing SB 54 and AB 450. Our proposed initiative would accomplish this. But simply repealing those two laws will not fully address the scope of the problems Californians face as a result of mass, unchecked illegal immigration. Long before SB 54, “sanctuary” jurisdictions in California have obstructed federal immigration enforcement, and with each legislative session illegal aliens are given more privileges by state lawmakers. These laws and policies must also be rolled back – and prohibited in the future.

Without laws on the books tying their hands – and criminalizing their obstructive behavior – politicians like Kevin de Leon, Jerry Brown, and Libby Schaaf will continue to prioritize illegal alien criminals and penalize law-abiding citizens and legal residents.

Schaaf, de Leon, and Brown claim SB 54 is needed to protect otherwise law-abiding illegal aliens who are victims of crime from being deported should they report a crime or serve as a witness. They claim that “dangerous” criminals will still be turned over to ICE, and that sanctuary cities are safe cities. Each one of those claims is a flat-out lie, and they know it.

Here are the facts Schaaf, de Leon, and Brown are hiding.

FACT: SB 54 does not contain any provision protecting otherwise “law-abiding” illegal aliens. SB 54 orders state and local law enforcement authorities to halt any cooperation with ICE or the Border Patrol – even simply sharing inmate release dates. SB 54 actually harms otherwise “law-abiding” illegal aliens by forcing ICE agents to apprehend criminal illegal aliens in the community instead of at a secure location like a jail.

FACT: As of January 1, 2018 thousands of “dangerous” criminals have been released to the streets instead of being turned over to ICE. Perhaps Schaaf, de Leon and Brown have a different definition of “dangerous” than we do, but we believe most Californians want drug dealers, drunk drivers, and sex offenders turned over to ICE and not set free. In Orange County alone, more than 240 criminals have been released back into the community instead of being sent to ICE.

FACT: The California cities which have embraced sanctuary policies for decades have the highest crime rates and highest rates of homelessness in the state. Immigrant neighborhoods in those cities are not any safer, in part because those are the neighborhoods to which illegal alien criminals return when they are released from county jails.

FACT: Because of Sanctuary State laws, innocent, law-abiding citizens and legal residents of California are being killed, raped, assaulted, and burglarized by illegal alien criminals who would not have been in a position to harm them otherwise. In February 2018, six-year-old Grace Aguilar was killed by a drunk driver who had previously been convicted of DUI – and who had been deported twice. He was not detained for ICE after his 2015 DUI conviction. In January, an illegal alien who had obtained a driver’s license and was driving for Uber was arrested for raping four college students.

Despite the facts, these politicians continue to lie to the people of California and smile as they go out of their way to subvert the work of federal immigration officers. California Attorney General Xavier Becerra is more motivated to attack AG Sessions, President Trump, and California employers than to rid the state of illegal alien felons.

For some reason our state’s leaders are hellbent on protecting illegal alien criminals instead of performing their sworn duties.

We’ve had enough.

Our ballot initiative, if passed, will:

  • Delete CA Government Code Sections 7284 through 7284.12, 7285, 7285.1, 7285.2, and Labor Code Sections 90.2 and 1019.2 (SB 54 and AB 450),
  • Require that state and local law enforcement notify federal immigration authorities when they have an illegal alien in custody,
  • Require that state and local law enforcement agencies fully cooperate with federal immigration authorities and honor detainer requests,
  • Impose criminal penalties and fines on government officials, government employees, and government agencies who obstruct federal immigration enforcement,
  • Prohibit the DMV from issuing new drivers licenses to illegal aliens, and make any drivers licenses currently held by illegal aliens non-renewable,
  • Require that voters provide documentation proving United States citizenship when registering to vote or before voting the first time, and
  • Require that county election boards retain such documentation for four years.

Fight Sanctuary State co-founder Agnes Gibboney remarked, “My son, Ronald, was murdered by a previously-deported illegal alien who is a gang member. His murderer is scheduled to be released sometime in 2020. Because of the Sanctuary State laws, I’ve been told that I will need an order from a federal judge for ICE to pick him up at the end of his sentence. Otherwise, he will be released to the streets. It’s time that these dangerous laws are done away with and that Californians are protected, not illegal aliens.”

Don Rosenberg, a Fight Sanctuary State co-founder whose son Drew was killed by an illegal alien criminal, said, “Most Californians would be horrified to realize the full impact of illegal alien crime in our state. Sanctuary policies kill our children and kill our dreams. I’ve been advocating for changes to our laws since my son’s death, and California’s leaders still don’t get it. Since they won’t take steps to put Californians first, the voters will do it for them.”

LA Times Columnist Blatantly Lies About Sanctuary State Bill in De Leon Article

In a piece analyzing CA Senator Kevin de Leon’s track record, LA Times political columnist George Skelton not only glosses over the Sanctuary Statue; he blatantly lies about what SB 54 does.

His controversial bill, which the Trump administration is challenging in court, basically decrees to state and local law enforcement: Leave immigrants who are undocumented but otherwise law-abiding alone, but help federal agents kick out serious criminals. It says local cops should focus on enforcing local laws, and let federal agents enforce their own immigration laws.

Skelton either hasn’t read the same bill we have, or he lacks the ability to comprehend English. Since he’s been a journalist for 50 years, we’ll assume he understands English, and let you draw your own conclusion about his motives.

The “California Values Act” does NOT “decree to state and local law enforcement” to “help federal agents kick out serious criminals.” It FORBIDS cooperation between federal agents and state and local law enforcement in kicking out serious criminals. Local law enforcement officers are not allowed to share any information with the feds that’s not publicly available and are NOT ALLOWED to honor ICE detainers.

De Leon, Gavin Newsom, Kamala Harris, and Jerry Brown have all taken advantage of a media culture that never challenges a word they say, feeding them misinformation and talking points knowing that the journalists won’t do the hard work of fact-checking or actually reading the bill. (We doubt most legislators read the bills either, so who can expect journalists to?)

Sen. Warren, Don’t Tell Me You’re Sorry For My Son’s Death

In February one of our founders, Don Rosenberg, was in Washington D.C. with a group of “angel parents,” parents who have lost a child to illegal alien crime.

After a chance meeting with Sen. Elizabeth Warren (D-MA), in which he told her about his Dreamer, Drew, he wanted to follow up with a more detailed explanation of the comment that provoked an angry, offended response from her.

Since we’re not sure the letter will get through to the Senator, we’re publishing it here as well.

Dear Sen. Warren,

You don’t know me, but I’m sure you remember me.

We “met” on February 7, 2018 in the corridor between the Dirksen and Hart office buildings.

We passed each other but when I called your name you stopped and approached me. I was holding a photo of my son, Drew, and said to you, “This is my Dreamer, my son Drew.” You smiled. He was a law student in San Francisco, I said, who was killed by an illegal alien in 2010. When I told you of his death you politely said how sorry you were for my loss.  I said, “No, you aren’t.” You angrily replied that I couldn’t judge what was in your heart. I said, “I’m not judging what’s in your heart; I’m judging you by your actions.”

I want to explain more about why I said that to you.

I’ve been involved in the illegal immigration issue almost every day for the past six years. I have a pretty good idea about how every politician stands on this issue. You and every other Democrat (of which I was one for 50 years) have ignored people like myself who have suffered the ultimate tragedy of having a loved one killed by someone who doesn’t even have a right to be here.

Now we have Oakland Mayor Libby Schaaf warning convicted criminals of their potential arrest. Not a word from you or any Democrat. Well, not quite. Here’s what Nancy Pelosi said:

“Fully half of those swept up in the ICE raids have no criminal record. This raid was intended solely to terrorize innocent immigrant families and instill fear in the hearts of our communities – not to keep Americans safe. Parents will now be torn from their children, and spouses ripped away from their loved ones.”

One of those “immigrants” (they’re not immigrants, they are illegal aliens) who had no criminal record (he did enter the country illegally) killed my son. Had he been deported when he was caught breaking the law (and although he was guilty the charges were dropped) that would have kept an American alive. That would have kept my son from being “ripped away” permanently from his “loved ones.”

Any admonishment from any Democrat for Pelosi’s comments? Where is your statement admonishing her? You, and every other Democrat are as much in denial about illegal alien criminality as the Republicans are about global climate change.

I wanted to make sure that I understood your position on the issue and researched any comments you may have made about controlling illegal immigration and deporting those who are here illegally. I wanted to see if I could find any utterance from you that we needed to secure our borders and at the very least deport those who committed additional crimes after coming here illegally. If you ever said anything remotely connected to that sentiment I couldn’t find it.

However, what I did find among numerous pro-amnesty clips were two that sum it all up.

The first was a tweet.

Really! Enforcing the law and deporting those here illegally who have then committed additional crimes is “dumb and dangerous but returning criminals – almost all of whom are repeat offenders – is “smart and safe”?

At the Netroots Convention on August 12, 2017, you said:

“Dreamers, who are as American as you and me, were promised a chance. They were promised a chance to work, a chance to live without being in fear of being ripped away from family and friends and the home that most of them have known. The chance to build a future.”

There’s not one thought in that statement that is true. They are certainly not as American as you or me. They were promised a temporary chance to work, a temporary chance to live without fear of being “ripped” away from family and friends and a temporary chance to build a future. They got that. Whether that temporary promise should be made permanent is another subject that shouldn’t be dealt with until at the very least those who have committed additional crimes are no longer protected by public servants hiding behind the absurd comment that releasing criminals back into society enhances public safety.

Tens of millions of American citizens and legal residents have been negatively financially impacted by illegal immigration (Dreamers have cost US citizens over 450 billion just to educate them in K-12). Tens of millions have been negatively impacted by criminal alien crime. In, 2016 alone there were over 200,000 illegal aliens in state jails and prisons and another 40,000 in federal prisons. The 52,000 illegal aliens in California jails and prisons were convicted of approximately 400,000 crimes.  Since the last amnesty somewhere over 50,000 Americans have suffered the ultimate, losing their lives to people who have no right to be here and been permanently ripped from their families and friends and have NO future.

They were promised Life, Liberty and the Pursuit of Happiness and instead they were ignored by you and your predecessors who sold them out for a vote and a buck.

Two board members of our advocacy group, Advocates for Victims of Illegal Alien Crime (AVIAC), Maureen Maloney and Maureen Laquerre, are citizens of Massachusetts. Ms. Maloney’s son was killed by an illegal alien as was Ms. Laquerre’s brother. They’ve tried to meet with you to no avail. Have you ever thought about reaching out to them?

I’m sure you don’t want to hear this, but you are an American Senator. Your first responsibility is to the health, safety and welfare of American citizens. Americans are killed and harmed every day by illegal aliens. You were so ready and did shut down the government for people here illegally. You and your fellow Democrats won’t even acknowledge the crimes committed by illegal aliens against Americans, immigrants and yes, even those here illegally.  Fourteen children and three adults were just gunned down in Parkland, Florida. Why no promise to shut down the government to protect American school children?

Whether DACA recipients should be given a “pathway to citizenship,” legal status or deported should be the last issue taken up in the illegal immigration debate. This Congress and the President have a first responsibility to the American people. As the Democratic Party and some in the Republican Party don’t seem to understand is that any provision that will allow some number of DACA recipients to remain in the United States permanently must wait. If they get deported so be it. I’m sure my son would prefer being deported anywhere in the world versus where he now resides.

If you would like to have a more civil conversation I will come to you whenever and wherever you choose. I look forward to your response, but won’t hold my breath.

As Predicted, Illegal Aliens Libby Schaaf Warned Have Already Reoffended

Oakland Mayor Libby Schaaf one-upped her Democrat colleagues last month by publicly warning illegal aliens that an ICE raid was imminent. Though ICE officials arrested hundreds of illegal alien criminals in the sweep, ICE Deputy Director Thomas Homan estimated that 800 people were able to elude arrest.

Anyone with half a brain knew it was just a matter of time until some of those who were able to avoid detection were out committing crimes again. Less than a month post-raid, and here are three who’ve already been picked up again. Via Washington Times:

[Homan] said one man had been released under sanctuary policies in November, after jail officials ignored an ICE request to hold him. His deportation officers tried to arrest the man last month as part of their enforcement action in Northern California, but after Ms. Schaaf’s warning he was one of the more than 800 who eluded them.

He has since been arrested for robbery and weapons violations, Mr. Homan said.

Another man was arrested for “injury of a spouse,” and a third was arrested for his third drunken-driving offense.

“So if he’s getting arrested three times, how many times has he committed this crime? That is a public safety threat,” Mr. Homan said.

Homan also said that according to intel picked up by ICE agents, smugglers cartels are touting sanctuary jurisdictions to entice migrants – promising they’ll be delivered to sanctuary jurisdictions “where they will be protected.”

With people like Libby Schaaf in charge, we know California’s politicians won’t willingly repeal sanctuary state laws. That’s why we’re bringing the vote directly to the people. Click here to tell Jerry Brown, Xavier Becerra, and Kevin De Leon, “We’ve had enough.”

Orange County Supervisor Calls On County to Follow Los Alamitos’ Lead

After the Los Alamitos City Council passed an ordinance Monday night exempting itself from the California Values Act, Orange County Supervisor Michelle Steel released a statement thanking the city’s leaders for their stance.

“I thank the City of Los Alamitos for standing up for its citizens and rejecting the so-called “Sanctuary” legislation passed in Sacramento, and I urge the County of Orange and all of our cities to do the same.

“Senate Bill 54 is dangerous because it blocks local law enforcement from working with federal authorities to remove criminals from our communities.

“Everyone remembers the tragic murder of Kate Steinle, an innocent 32-year-old woman, in 2015. She was shot and killed by an illegal immigrant, Francisco Sanchez, who had already been deported 5 times and racked up 7 felony convictions.

“According to press reports, before the murder, ICE officials asked the San Francisco Sheriff’s Department to inform them when Sanchez would be released so that federal agents could pick him up. But the sheriff’s department said, in keeping with “Sanctuary City” policies, it does not hold detainees on requests from federal immigration officials unless there is a warrant for their arrest.

“Since Senate Bill 54 became effective on January 1, the Orange County Sheriff’s Department ended its federal 287(g) program, under which Sheriff’s Deputies screened inmates and notified Immigration and Customs Enforcement of the pending release of incarcerated illegal immigrants.

“We cannot allow this to happen in Orange County. Orange County should follow federal law and fully cooperate with immigration enforcement to identify and arrest dangerous illegal immigrants.

“We need to protect our families and our homes here in Orange County, and that means bolstering our cooperation with federal immigration enforcement and stopping our county from becoming a sanctuary for criminal illegal immigrants.”

According to this report from the Orange County Register, the true #resistance is spreading.

In Aliso Viejo, Mayor Dave Harrington said his council plans to discuss similar action at its April 4 meeting.

“It is a great thing what they did,” Harrington said of the Los Alamitos vote. “I think they were spot-on; that we take the oath of office to uphold the Constitution of the United States.”

Buena Park Councilwoman Beth Swift said she plans to request at the next council meeting for the issue to be placed on a future agenda for discussion.

Another city that had been discussing something similar, even before Los Alamitos’ vote, is Huntington Beach, according to Assemblyman Travis Allen, a Republican who represents both Huntington Beach and Los Alamitos.

“Tiny Los Alamitos has kicked open the door and now other cities across California are looking to get onboard and stand up against the illegal sanctuary state,” Allen, who is running for governor, said Tuesday.

We, too, call upon other cities and counties to stand up to Sacramento and refuse to follow their reckless, immoral, and unconstitutional sanctuary laws until we can bring a permanent solution to the voters.
